New Jersey
NEW JERSEY Statute: NJ Stat Ann 26:8-40.12 (2004)

New Jersey will change both name and sex, and will issues a new birth certificate rather than amend the old one.

Changes required are handled by the Modification Unit and are accepted ONLY by mail. YOU CAN NOT DO THIS IN PERSON.

Along with the letter requesting the change, you must submit the following:
1. Application fee of $6.00 US in the form of a personal check or money order made out to: New Jersey State Treasurer.
2. A seal copy of the court order of the name change.
3. A NOTARIZED copy of the surgeon’s letter.
4. Your original birth information. It can be hand written, including date, place (municipality), parents. (Or submit copy of the birth certificate.

Updated New Jersey information as of November 2002:

The filing fee for the name change was $175.00, and you must post an ad in the local paper, once, prior to the judgment being rendered, and once after. The cost of the ads depends on the local newspaper. There is a fee of $5.00 for each copy of the rendered judgment to be sealed, and the seal is essential for it to be used to change other documents. The document also has to be registered with the State, and that is an additional $50.00 fee. As far as the gender change, one contact the State Department of Health to petition the gender change, and you can include the court order only after it’s validated by the state. A simple letter, however, from the surgeon will not suffice; they require a notarized copy of the actual surgical report. Changing the New Jersey driver’s license also requires proof of SRS having been performed.

CODE:
The State Registrar shall issue an amended certificate of birth from a person born in this State who undergoes sex reassignment surgery and requests an amended certificate of birth which shows the sex and name of the person as it has been changed.
